While common sense would tell you to leave your PSP be while you're
doing 80 across the highway, the senate has gotten up to take extra
steps to make sure that you won't make that potentially fatal mistake.
A new bill has just been passed, and it will soon be illegal in New
York state to text, browse the net, or play video games while driving. This new bill, which slaps a fine of up to US$ 150 on violators who are caught texting, chatting on the phone, surfing, or gaming while driving, was passed by an overwhelming majority in legislation. The use of the cellphone while driving is already illegal in the state, so this bill widens the scope of portable electronics included in the ban. This bill will also make it a bit tougher to secure driver's licenses. Applicants must have their learner's permit for at least six months and complete 50 hours of supervised driving before they can apply for the regular license. And in case you were wondering, returning a message while you're stuck in traffic counts. So keep that phone tucked safely away while you're behind the wheel. Laws and video games:

Yea, because people really game and drive... I see the conservatives have gotten into the DMV now too, huh?

It's New York, you really shouldn't be surprised at what their drivers will do while driving.

you really can't be suprised with what people do while they driving. It usually isn't gaming though but you would see people doing any type of morning routine in the car basically. Makeup Flossing, brushing their teeth.... getting dressed, and hell one time I saw a guy using mouthwash and he opened his window and spit it out.

It should be more than just a $150 fine...
It should be treated more or less along the lines of drunk driving.

okay, i'm not thinking it's ridiculous that lawmakers are doing this. I'm thinking it's ridiculous that it's gotten to the point where they've felt that they have to do this. I mean okay, maybe they tacked on the whole gaming portion on top of the texting thing. I understand that. But wow, seriously? That's incredible. I have to admit, it makes a lot more sense than here in Cali. The law against speaking on the phone is enforced, but what I hear is that there's nothing stating that you can't text. Can anyone verify this? I'd really like to know for sure. After all, wikipedia isn't always trustworthy.

» it's true.
Even if your just texting, your still using your phone while driving. I'd say it's worse than taking a call due to the fact that your looking most of the time at your phone display. As least with a call you can still watch where your going.
I agree with this idea. To be fair, you've got to be bloody stupid it think playing a mobile phone game while driving is ok.

I am thinking the law applies to just using your cellphone in your hand while driving.
There is really no way a cop driving by, or watching you at the lights would be able to tell if you are texting or playing a game....
Also a good law, but who knows how much it will be enforced. Talking on a cell (while driving) is illegal here, but I see people doing it all the time, and have seen cops at lights look at people doing it and just ignore em.

It's not about making things safer.
It's about THE MONEY. New ways to tax you. New ways to fine you. New ways to levy fees on you.

... Is it even possible to play a game whilst driving?
Maybe I like in a place where you don't get many traffic jams or whatever. But this seems mad. There must be people doing this and causing accidents otherwise it wouldn't have been brought to whoever constructed this law's attention.

this is political correctness gone mad i hope they don't adopt this law in my area cus i'm not gonna stop. just because a couple of idiots have really bad hand eye co-ordination and can't multitask, now i'll have to take my psp off its steering wheel mount and start holding it under the line of the dash so it can't be seen from outside. which really will be a little dangerous. especially for someone who doesn't have my spacial awareness and multitasking skills.
Jesus! i thought the Nazi's lost ww2

Just watch the motorways at 8.30am and you'll see people simultaniously putting on makeup, drinking coffee and making a phone call and steering with their knees, you can't complain when the law finally has enough sense to make sure people's first priority is driving.

» Do We?
Do we really need a law for this? Seriously. Ask yourself how many laws you're breaking walking down the street?
Cross the street not at a corner/crosswalk? Jaywalking. Spit something out of your mouth? Legal, but you can still get fined in Chicago by overzealous police officers. Talking on your phone while driving? Illegal as well, in Chicago.
How is this going to be enforced? Say I pick up my phone to see who is calling while driving, and a cop claims I was playing a game. Who is the court going to believe? Let's say I want to fight it. That's time out of MY day and MONEY out of MY pocket for something I didn't even do.
You say, "It'll just be an additional fine if you're caught speeding or something."
BULL- *****.
They used to add fines for not wearing your seatbelts during a traffict, and now they ISSUE YOU A TICKET AND TAKE AWAY YOUR LICENSE IF YOU HAVE IT here in Faillinois.
Politicians need to be taken out and shot, all of them.

Police will issue you a ticket and take away your license even if you are just a passenger of an automobile riding without a seat belt on.

» What about hands free and GPS?
This sounds one step away from banning GPS.
No discussion yet of hands-free kits for phones? Like earpieces or holders on the dash board. Some cars even have the steering wheel tailored for phones. Are these all prohibited goods in New York?

Looking at a gps is hardly any different from looking at your car dials, and apart from setting your destination which is done before you start your hands never have to leave the wheel, it's only stuff that removes your hands from the wheel, or is a distraction like a tv that will be banned, i'll admit the most dangerous thing i did was use internet on phone for about 6 miles on motorway, but never again.

What the F*ck is wrong with people these days. It reminds me of the movie Idiocracy. Some day people will be so damn retarded that they will have to make laws, that someone monitors us during breakfast, so that we don't kill ourselves.

I like how 99.99% of the people commenting don't even live in NY!!!!
Seriously people, use your brains!!!! NY? Stop and go? Never ending city traffic? The problem stems from people who are BORED IN STOPPED TRAFFIC playing their games. Then, aren't paying attention or traffic speeds up but people dont want to stop their games... blah blah blah...
Same goes for any major city. Idiot people using ANYTHING while driving is getting bad.

» i have a question
i don't live in NY but drive there quite a few times a year. i have a PSP mounted in my car for playing music, so does that count as playing a gaming device? if so i guess i just have to turn it off and put it on the passenger seat, if i get pulled over in NY

It does not count. You aren't holding the device and you aren't paying attention to it. It's mounted safely, playing music. Nothing wrong with that. No different from your radio.
However, if you are using it and driving in an unsafe manor you'll get a ticket for driving in an unsafe manor.... pretty simple.
